Missoula County opposes HB 486: Generally revise county road access laws, up for hearing this afternoon in the House Transportation Committee. Though Missoula County is supportive of adding more consequences to the placement and refusal to remove encroachments, we do not agree with how this bill attempts to remedy these situations. Using the term “individual,” the bill doesn’t clarify who can bring an action forward, and does not establish what constitutes a valid petition, which has the potential to both overwhelm local government with requests for encroachment removal and to pit neighbor against neighbor. The bill also doesn’t clarify who decides or how it is decided that an object is encroaching into a public right-of-way.
