Missoula County supports, as amended, SB 331: Revise condo and townhouse exemptions, up for hearing Tuesday in Local Government.
As amended, this bill maintains the ability of communities to use form-based codes in Montana. Form-based codes are relatively new to Montana but have a proven track record at increasing housing supply. Traditional zoning over-emphasizes the separation of uses and prohibits mixing of housing types, while form-based codes are designed to allow mixed-use and various housing types like accessory dwelling units, cottage courts, duplexes and tiny homes by right, meaning no additional review is necessary. Missoula County has adopted two form-based codes in the past three years, greatly increasing the density of housing allowed by right where the codes apply. This bill would allow the County to continue these practices.
