Missoula County opposes HB 405: Revise laws related to grand juries, up for hearing at 8 a.m. Monday, Feb. 13, in the House Judiciary Committee. HB 405 would allow a small portion of the population of a community - less than one percent - to convene a grand jury and investigate any matter it chose whether illegal in nature or not. In addition, HB 405 would then require a county attorney to prosecute those indictments handed down by a grand jury that has met without legal counsel or understanding of the law. HB 405 flies in the face of the American criminal justice system by creating mob rule and removing the proper use of prosecutors and their discretion.
