Missoula County opposes SB 545, Revise local government building code laws, up for hearing this afternoon in Local Government. This bill would allow contractors building a house to waive certain requirements around foundations needed to ensure sound construction. Subsequent owners would not know about this waiver and the potential risks and would have no recourse if the foundation fails. Additionally, soil conditions vary widely. Taking away soils reports with a waiver guarantees future problems with no solution. Currently, a county building official can waive the soils reports if they feel confident in the local conditions. This legislation would remove that power, to the detriment of the buyers and homebuilders.
